
There are numerous media reports that the White House – Trump and White House Council Dan McGahn – are severely limiting the FBI’s extended background investigation of Brett Kavanaugh. Reports seem to indicate that the investigation will be limited to “credible” accusations of sexual assault which will could be interpreted to exclude an investigation of the accusations of Julie Swetnick simply because she chose to have Michael Avenatti represent her. In Trump’s mind makes her automatically “not credible”.
Media reports also indicate that the FBI might not be able to investigate credible reports that Kavanaugh lied under oath to Congress about his drinking habits in high school and his early years at Yale. Several of Kavanaugh’s drinking companions at Yale – both men and women – have issued sworn statements that Kavanaugh lied to the Senate Judiciary Committee because he was often a stumbling drunk who slurred his word and acted belligerently. One woman said she found it almost impossible to believe that Kavanaugh could remember later what he did when he was really plastered, which was often. There have also been indications that Kavanaugh lied about the meaning of words he wrote in his high school year book.
These testimonies not only speak to whether Kavanaugh lied to Congress about high school and college experiences , which is a federal crime which would disqualify him from being a federal judge at any level, but they also address the the only explanation which allows for the possibility that both he and Dr. Ford were telling the truth about the attempted rape. If Kavanaugh was so drunk at the time that he doesn’t remember the assault, he could be truthfully stating his belief that it never happened.
Therefore, this issue should be front and center of the FBI investigation. It has already been demonstrated that an investigation of the alleged sexual assaults, even those perpetrated on Deborah Ramirez and Julie Swetnick, will most likely result in a “he said she said” situations. However, if a federal Appeals Court judge intentionally misled and lied to Congress, he is not only ineligible to be a Supreme Court Justice, he is also is unqualified to maintain his current position on the bench.
